Terms of Service
1. Acceptance of terms
By accessing or using SwimBase (the "Service"), you agree to these Terms of Service. If you don't agree, please don't use the Service. If you use the Service on behalf of a team, club, or organization, you represent that you're authorized to accept these terms for them.
2. Eligibility
You must be at least 18 years old to create a SwimBase account. SwimBase is intended for coaches and team administrators. Minors may have their performance data stored in the Service only when a coach or authorized adult uploads it consistent with these terms and our Privacy Policy.
3. Accounts
You're responsible for activity under your account and for keeping your sign-in secure. Tell us promptly if you suspect unauthorized use. We may suspend or terminate accounts that violate these terms.
4. Acceptable use
You agree not to:
- Upload data you don't have the right or authorization to share.
- Access data belonging to another team or user you aren't authorized to access.
- Reverse engineer, scrape, overload, or interfere with the Service or its security.
- Use the Service to violate any law or another person's rights.
- Misrepresent your identity or your authority to act for a team or organization.
5. Your data and uploads
You retain ownership of the data you upload ("Your Content"). You grant SwimBase a license to host, process, and analyze Your Content solely to provide and improve the Service for you and your team.
You are responsible for the data you upload. When you upload meet results or other information about swimmers — including minors — you represent that you have the authority and any consents required by law to provide that data to SwimBase for team analytics. You're responsible for the accuracy of what you upload, and for deleting data you no longer have the right to store.
6. The in-app assistant
SwimBase includes an AI assistant that answers questions using your team's data. It can be wrong or incomplete and is provided for informational purposes only. It is not professional coaching, medical, training, or other expert advice. Use judgment before acting on its output.
7. Intellectual property
The Service — including its software, design, and content we provide — belongs to SwimBase and is protected by intellectual-property laws. These terms don't grant you any rights in the Service except the limited right to use it as permitted here.
8. Third-party services
The Service relies on third parties (such as Supabase, Google, OpenAI, and Vercel). Your use of the Service may be subject to their terms, and we aren't responsible for third-party services we don't control.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that analytics will be accurate.
10. Limitation of liability
To the maximum extent permitted by law, SwimBase will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred US dollars ($100) or the amount you paid us in the twelve months before the claim, whichever is greater.
11. Indemnification
You agree to indemnify and hold SwimBase harmless from claims arising out of your data, your use of the Service, or your breach of these terms — including claims that you lacked the right to upload data you provided.
12. Termination
You can stop using the Service and delete your account at any time. We may suspend or end your access if you violate these terms or if we discontinue the Service. Sections that by their nature should survive termination (such as ownership, disclaimers, and liability) will survive.
13. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree that any disputes will be handled in the courts located in Delaware, unless applicable law requires otherwise.
14. Changes to these terms
We may update these terms from time to time. When we do, we'll revise the "Last updated" date above. Continuing to use the Service after changes take effect means you accept the updated terms.
